Il Supreme Court Says State Farm Must Cover Cost Of Faxes

The Illinois Supreme Court has ruled State Farm Insurance can't avoid paying a claim for a business in Indiana by claiming a conflict between Illinois and Indiana law. The owner of the Bridgeview Healthcare Center is based in Illinois, though the policy was taken out in Indiana. Bridgeview sued a hearing aid company in West Lafayette, Indiana called Affordable Digital Hearing for sending unsolicited faxes and costing time, toner, and ink expenses. State Farm had argued a couple of federal court decisions in Indiana "predicted" a conflict between Illinois and Indiana law and that Indiana courts would reject insurance coverage. The Illinois High Court ruled the Bloomington based company didn't actually demonstrate a conflict existed. The decision reverses an appeals court decision. The case has been going on for eight years now.
