Bloomington Alderman Jennifer McDade has filed her appeal in circuit court of the Bloomington Election Commission Board decision removing her from the ballot for faulty petitions. McDade has characterized the errors of not listing the 5th ward or the date of the primary on her petitions as administrative and technical. Mathew Koetters who filed the challenge says that's not the case.
"You are petitioning to get on the ballot for a certain election which is being held on a certain date. It is not a harmless error. It is a significant error."
McDade has argued that other Bloomington council candidates failed in the same ways. But, Koetters says the relevant standard is not what other candidates do, it is the statute. Judy Green, the Chair of the Election Commission Board which ruled on the challenge says she has not been served with the suit yet and cannot comment.
